Terms of Service

1.1 Electronic Acceptance: By clicking or tapping "I Agree," "Continue," "Sign Up," "Sign In," "Sign in with Google," "Send Login Code," "Generate," "Purchase," "Download," or other buttons with a clear action meaning, or by continuing to use interactive features after being presented with these Terms, you provide your electronic signature/electronic acceptance and agree to be bound by these Terms. Such actions may be retained as an electronic record of your acceptance. If you disagree with any part of these Terms, you must not access or use the Service, and you should immediately discontinue any use. Merely browsing public pages does not, by itself, constitute separate acceptance of the name-generation or paid-service terms; however, you must still comply with the rules that apply to public access.

1.2 Eligibility: You represent that you are at least 18 years old (or the age of majority in your jurisdiction). If you are under 18, you may only use the Service with the explicit involvement and consent of a parent or legal guardian.

1.3 Privacy: Our collection and processing of your personal information is governed by our Privacy Policy, available at https://mychname.com/privacy. By using the Service, you acknowledge that you have read and understood the Privacy Policy's descriptions of personal information processing, AI processing, Cookies, and cross-border transfers. Processing necessary to enter into or perform the service contract will be carried out in accordance with the Privacy Policy and applicable legal bases. Where separate or explicit consent is required by law, we will request it through the relevant feature or Cookie Preferences.

2.1 Service Nature: myCHName provides AI-assisted generation of culturally curated Chinese names, etymological analysis, poetry, and neural audio outputs ("Artifacts") utilizing advanced Large Language Models provided by third parties and human-in-the-loop systems.

2.2 Free Preview:We may offer a free preview of the Service (e.g., sample name generation without premium download rights). Any preview is provided "as is" without warranty and may be discontinued at any time. Payment is only required for premium, downloadable Artifacts.

2.3 No Legal or Professional Advice: The Artifacts are generated for personal, cultural, and aesthetic enjoyment only. They do not constitute legal advice, immigration advice, trademark counsel, or official name certification.

2.5 AI Disclaimer: Due to the probabilistic nature of AI, outputs may vary. We do not guarantee that the Service will be error-free or culturally appropriate in every single context. You acknowledge that AI-generated content may contain errors, inaccuracies, or unintended cultural connotations, and you agree to use your own judgment when relying on any generated output.

3.1 Definition of Delivery: The Service is considered fully delivered at the earlier of: (a) when the Artifacts are displayed on your screen; or (b) when a download link is made available in your dashboard.

3.3 Technical Issues: If a technical failure prevents delivery, please contact support@mychname.com within 48 hours. We will, at our discretion, either re-run the generation or issue a refund.

3.4 Payment Processing: Payments are processed by third-party payment processors. We do not store your payment card information. Our liability for payment issues is limited to assisting you in contacting the relevant processor.

3.5 One-Time Purchase Only: Currently, all purchases are one-time payments for a perpetual license as described in Section 4. We do not offer subscription-based recurring billing at this time.

4.1 "Permanent Ownership": You are granted a perpetual, non-exclusive, worldwide, royalty-free license to possess, use, display, and modify the generated Artifacts for any lawful purpose, including commercial branding.

4.2 Preservation: You are solely responsible for downloading and saving your Artifacts to your local devices. myCHName is not a permanent cloud storage provider.

4.3 No Liability for Data Loss: myCHName shall not be liable for loss of Artifacts due to server failures, account termination, or service discontinuation.

4.4 Discontinuation: Subject to Section 14 (Force Majeure), if we discontinue the Service, we will provide at least thirty (30) days' notice via email to registered users to allow for final downloads.

5.2 Consequences: We reserve the right to reject violating content, terminate accounts, and refuse refunds for violating users.

6.1 License to You: Upon full payment, you may use the Artifacts for personal or commercial purposes. No additional royalties are required.

6.2 Reservation of Rights: myCHName retains all rights to the underlying AI models, software code, UI design, and brand assets.

6.3 No Warranty of Non-Infringement: You are solely responsible for conducting trademark clearance if you intend to use a name commercially.

7.1 Governing Law: These Terms shall be governed by the laws of the People's Republic of China.

7.2 Dispute Resolution: Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be submitted to binding arbitration in Dongguan, Guangdong Province, China, in accordance with the arbitration rules of the Dongguan Arbitration Commission (东莞仲裁委员会). The arbitration proceedings shall be conducted in Chinese. The arbitration award shall be final and binding. To the fullest extent permitted by law, you agree that any dispute shall be conducted solely on an individual basis and not as a class action.

8.1 Disclaimer:TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

8.2 Cap on Liability: OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

8.3 Mandatory Rights: Nothing in these Terms excludes liability for death, personal injury, or fraud that cannot be excluded under applicable law.

9.1 Right to Modify: We reserve the right to update or modify these Terms at any time.

9.2 Notice: For material changes, we will post the updated Terms here and, if applicable, notify you via email at least fifteen (15) days before they take effect.

9.3 Continued Use: Your continued use of the Service after changes constitutes acceptance of the new Terms.

12.1 General Deletion: You may request account deletion by contacting support@mychname.com. We will process requests within thirty (30) days, subject to legal retention obligations.

12.2 GDPR Rights (for EU Users): If you are located in the European Economic Area (EEA), you have the right to request access to, rectification of, or erasure of your personal data. Contact us at privacy@mychname.com for such requests.
